Withdrawal Liability Liaison

PURPOSE:
Coordinates with Employer Services and Contribution Compliance to determine when employers terminate participation in the IAM National Pension Fund. Respond to Employer requests for estimates of withdrawal liability, coordinating with the Fund’s actuaries on both estimate and final calculations of withdrawal liability. Support outside counsel and litigation staff counsel in litigation to enforce the obligation to contribute and
ESSENTIAL DUTIES AND RESPONSIBILITIES:
- Under attorney supervision, coordinate with Employer Services, Education and Contribution Compliance regarding the status of withdrawn employers and withdrawal liability cases.
- Review and finalize the payment arrangements with withdrawn employers, assist attorneys in negotiating payment plans when necessary, and update the account information, when appropriate.
- Prepare updates/input for new referrals/organize and properly close matters where appropriate, etc.
- Prepare, create, and provide timely collection status reports to General Counsel.
- Update and maintain withdrawal liability records.
- Coordinate administrative functions of the Department’s collections programs on behalf of the Funds, including assisting lawyers with review and distribution of letters to delinquent employers.
- Perform factual research under attorney supervision.
- Conduct controlled-group analysis under attorney supervision.
- Organize and analyze information from withdrawal liability questionnaires.
- Cross-check and validate information from withdrawal liability questionnaires.
- Prepare written reports.
- Review legal documents including contracts, confidentiality/non-disclosure agreements, plan amendments, plan policies and procedures, reports including financial reports, performance metrics and key performance indicators, lease agreements, briefs, pleadings, appeals, and legal memoranda, under attorney supervision.
- Coordinate employer withdrawal liability estimates and assessments with the Fund’s actuaries.
- Prepare correspondence to employers.
- Organize and track matter and case files.
- Review and monitor arbitration and court decisions in Fund cases.
- Work with staff attorneys on employer requests for review and 4204 transactions.
- Monitor regulations and case law developments involving withdrawal liability.
- Other duties as assigned.
EXPERIENCE
- Thorough knowledge of collective bargaining agreement processes and procedures.
- Thorough knowledge of contribution accounting processes and procedures.
- Thorough knowledge of the National Pension Fund trust agreement and withdrawal liability policy.
- Working knowledge of V3.
- Relevant computer knowledge and experience, including experience with Microsoft Word, Excel, and PowerPoint.
EDUCATION
- Bachelor’s degree in business or accounting or prelaw.
- Paralegal experience or certification a plus.
- ERISA courses a plus.
